If you do not agree with these Terms, you should not use the Website.

Nothing in these Terms limits any rights that cannot legally be waived under applicable consumer protection or other laws.

2. Website Content Is for Informational and Educational Purposes

The Website contains information about maternal health, obstetric fistula, childbirth injuries, healthcare systems, programs, partner organizations, individual experiences, and related subjects.

This information is provided for general informational, educational, advocacy, and charitable purposes.

Not Medical Advice

Nothing on the Website constitutes medical advice, diagnosis, treatment, or a substitute for consultation with a qualified healthcare professional.

Maternal Dignity Project does not provide medical care through this Website, and use of the Website does not create a healthcare provider-patient relationship.

If you have questions about your health or medical care, you should consult an appropriately qualified healthcare professional.

If you believe you are experiencing a medical emergency, contact your local emergency services or seek immediate medical attention.

No Professional Advice

Website content should also not be considered legal, financial, tax, accounting, or other professional advice.

You should consult an appropriate professional when advice specific to your circumstances is required.

3. Accuracy of Information

We make reasonable efforts to provide accurate, useful, and current information.

However, maternal health information, statistics, programs, partnerships, laws, policies, research, medical practices, and other information can change over time.

We do not guarantee that every item on the Website will always be complete, current, error-free, or applicable to every circumstance.

When we become aware of a material error, we may correct or update Website content.

4. Stories and Individual Experiences

The Website may include personal stories, testimonials, interviews, quotations, photographs, videos, or other accounts involving women, families, healthcare providers, partners, supporters, and other individuals.

These materials may describe individual experiences and should not be interpreted as guarantees that another person will experience the same medical, personal, social, or program outcome.

We seek to present stories respectfully and in accordance with applicable permissions, safeguarding practices, and organizational standards.

Some names, identifying details, photographs, or other information may be changed, limited, withheld, or presented in a manner intended to protect privacy or safety where appropriate.

5. Donations

The Website may allow you to make donations to Maternal Dignity Project directly or through a third-party fundraising or payment platform.

By making a donation, you represent that:

  • You are authorized to use the payment method provided.

  • The information you provide in connection with the donation is accurate.

  • Your donation is being made voluntarily.

  • Your donation does not violate any applicable law.

Donation Processing

Donations may be processed by third-party fundraising or payment providers.

Those providers may have their own terms, privacy policies, processing practices, and fees. When you use a third-party donation service, your use of that service may also be subject to the provider’s terms.

We encourage you to review applicable information presented during the donation process.

Donation Designations

When Maternal Dignity Project permits donors to indicate a preferred program, project, geographic region, or purpose for a donation, we will make reasonable efforts to honor that preference.

Unless we expressly state that a donation is legally restricted to a particular purpose, however, the indication of a preferred use does not necessarily create a legally restricted gift.

Where permitted by applicable law and applicable donor restrictions, Maternal Dignity Project retains discretion to use charitable funds where they can most effectively support the organization’s mission and programs.

Donation Receipts and Tax Treatment

We may provide receipts or acknowledgments for donations.

The tax treatment of a donation depends on the donor’s circumstances and applicable law. Maternal Dignity Project does not provide individual tax advice.

You should consult a qualified tax professional regarding the deductibility or other tax consequences of a donation.

Donation Errors and Refund Requests

Donations are generally considered completed once processed.

However, if you believe a donation was made in error, duplicated, processed for an incorrect amount, or made through unauthorized use of a payment method, contact us promptly at info@maternaldignityproject.org.

We will review reasonable refund or correction requests based on the circumstances, applicable law, and the policies of the payment processor involved.

Nothing in this section limits any refund, cancellation, chargeback, or other rights that you may have under applicable law.

6. Email Communications

You may have the option to subscribe to newsletters, organizational updates, fundraising messages, event information, or other communications from Maternal Dignity Project.

You may unsubscribe from promotional emails at any time by using the unsubscribe link included in the communication.

Certain administrative or transaction-related communications, such as donation receipts or responses to inquiries, may still be sent when necessary.

9. Photographs, Videos, and Personal Stories

Photographs, videos, stories, interviews, testimonials, and other materials involving identifiable individuals may be subject to privacy, publicity, copyright, safeguarding, or contractual protections in addition to ordinary copyright law.

The fact that this material appears publicly on our Website does not mean that it may be freely reused for advertising, fundraising, commercial campaigns, artificial intelligence training datasets, or other unrelated purposes.

Please contact us before reproducing or republishing identifiable participant stories, photographs, or videos outside ordinary personal sharing of links to our Website.

10. Trademarks

The Maternal Dignity Project name, logos, branding, campaign names, and other identifying marks may be trademarks or otherwise protected.

You may not use these marks in a manner that falsely suggests that Maternal Dignity Project sponsors, endorses, approves, or is affiliated with you, your organization, a product, a service, or a campaign.

11. Third-Party Websites and Services

The Website may contain links to or integrations with third-party websites and services, including:

  • Donation and payment platforms

  • Email services

  • Social media platforms

  • Video services

  • Maps

  • Analytics services

  • Partner organizations

  • Healthcare organizations

  • News or research sources

  • Other external resources

These services are operated independently from Maternal Dignity Project.

We are not responsible for the content, security, availability, accessibility, terms, privacy practices, or actions of third-party websites or services.

A link to a third-party resource does not necessarily constitute an endorsement unless we expressly state otherwise.

Your interaction with a third-party service is governed by the terms and policies applicable to that service.

12. Partner Organizations

The Website may identify or link to hospitals, healthcare providers, community organizations, nonprofit organizations, governmental organizations, funders, program partners, and other entities.

References to a partner or other organization should not be interpreted as a guarantee regarding that organization’s services, medical outcomes, financial condition, security practices, or actions unless expressly stated.

Each organization remains responsible for its own activities and services.

13. Privacy

Your privacy is important to us.

Our Privacy Policy explains how we collect, use, disclose, retain, and protect personal information, as well as choices and rights available to individuals in certain jurisdictions.

Our use of cookies, Google Analytics, and similar technologies is also addressed in the Privacy Policy and through our cookie preference tools where applicable.

The Privacy Policy forms part of these Terms by reference.

14. Children

The Website is intended for a general audience and is not specifically directed to children under 13.

If you are under the age at which you may legally consent to use an online service in your jurisdiction, you should use the Website only with appropriate involvement of a parent or legal guardian.

15. Website Availability

We work to maintain the Website, but we do not guarantee that it will always be available without interruption.

We may temporarily suspend, restrict, update, replace, or modify portions of the Website for reasons including:

  • Maintenance

  • Security

  • Technical problems

  • Website improvements

  • Changes to programs or content

  • Legal or regulatory requirements

We are not responsible for interruptions that are outside our reasonable control.

16. Security

We take reasonable measures designed to protect our Website and systems.

However, no website or electronic system can be guaranteed to be completely secure.

You are responsible for using reasonable precautions when accessing websites, opening links, downloading files, and communicating information online.

If you believe you have identified a security issue involving our Website, please contact info@maternaldignityproject.org.

17. Disclaimer of Warranties

To the extent permitted by applicable law, the Website is provided on an “as available” basis.

We do not make warranties regarding matters such as uninterrupted availability, error-free operation, or the suitability of general Website information for a particular individual’s circumstances.

This disclaimer does not exclude any warranty, guarantee, consumer right, or other protection that cannot legally be excluded or limited.

18. Limitation of Liability

To the extent permitted by applicable law, Maternal Dignity Project and its directors, officers, employees, volunteers, and agents will not be liable for indirect, incidental, special, or consequential losses arising solely from use of or inability to access the Website.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

In particular, these Terms do not exclude or restrict liability for:

  • Fraud or fraudulent misrepresentation.

  • Intentional misconduct.

  • Liability that cannot legally be waived or limited.

  • Death or personal injury to the extent applicable law prohibits such a limitation.

  • Rights or remedies provided under mandatory consumer protection law.

If applicable law gives you rights that conflict with a limitation contained in these Terms, those statutory rights remain unaffected.

19. Indemnification

To the extent permitted by applicable law, if you intentionally misuse the Website or unlawfully infringe the rights of Maternal Dignity Project or another person, you may be responsible for losses or costs reasonably resulting from that conduct.

This section does not require consumers to indemnify Maternal Dignity Project for matters arising from our own unlawful conduct, negligence, or failure to comply with obligations that cannot legally be waived.

20. Governing Law

These Terms are generally governed by the laws applicable in the State of Oregon, United States, without regard to conflict-of-law principles.

However, this choice of law does not deprive you of mandatory rights or protections provided by the laws of the country, state, province, or other jurisdiction in which you reside when those protections legally apply.

Nothing in these Terms requires a consumer to bring a claim exclusively in Oregon when applicable consumer law gives that consumer the right to bring a claim elsewhere.

21. European and International Users

If you access the Website from the European Economic Area, United Kingdom, Switzerland, or another jurisdiction with mandatory consumer protection laws, those laws may provide rights in addition to these Terms.

Nothing in these Terms is intended to:

  • Waive rights that cannot legally be waived.

  • Impose an unfair contractual term.

  • Prevent you from exercising applicable consumer rights.

  • Restrict access to a court or remedy that applicable law requires to remain available.

If a provision of these Terms conflicts with a mandatory legal protection that applies to you, the mandatory protection will control to the extent of the conflict.

22. California Users

Nothing in these Terms limits any rights available to California residents under applicable California law that cannot legally be waived.

Our handling of personal information and privacy requests is described separately in our Privacy Policy.

23. Changes to These Terms

We may update these Terms periodically to reflect changes in:

  • Our Website

  • Our programs or services

  • Applicable laws

  • Technology

  • Security practices

  • Organizational operations

When we make changes, we will update the Last Updated date at the top of this page.

Changes will apply prospectively from the date they are posted unless applicable law requires another form of notice or consent.

If a change materially affects existing legal rights and applicable law requires notice or consent, we will provide it as required.

24. Severability

If a court or other competent authority determines that a provision of these Terms is invalid or unenforceable, that provision will be interpreted or limited to the extent legally permitted.

The remaining provisions will continue to apply where legally permissible.

For consumers protected by mandatory consumer law, this section does not permit us to replace an unlawful term with another term that would itself be unfair or unenforceable.

25. No Waiver

If we do not immediately enforce a provision of these Terms, that does not necessarily mean that we have permanently waived the right to enforce it.

Similarly, nothing in these Terms limits rights that you cannot legally waive.

26. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms expressly presented in connection with a particular Website feature or transaction, constitute the terms governing use of the Website.

Separate agreements entered into directly with Maternal Dignity Project may contain additional or different terms and will govern to the extent they apply to the subject of that agreement.
